Terms of Use
The agreement between you and Literary Atlas. It covers your account, the books you bring with you, the Premium subscription, and what to expect from beta software.
1. Who you are agreeing with
Literary Atlas is developed and operated by Boris Prosper (boris.prosper@gmail.com), referred to below as "we", "our" or "us". "You" means the person using the app.
By downloading, installing or using Literary Atlas, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app.
2. Who may use it
You must be at least 13 years old to use Literary Atlas, and old enough to enter a binding contract where you live. If you are under the age of majority in your region, you may only use the app with the involvement of a parent or guardian, who accepts these Terms on your behalf.
3. Your account
Some features need an account, created with Sign in with Apple or with an email address. You are responsible for the accuracy of what you provide and for keeping your sign-in details confidential. Tell us promptly if you believe someone else is using your account.
You can delete your account at any time from Settings → Account → Delete Account in the app, or by writing to us. See deleting your account for what is removed and what remains.
4. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Literary Atlas on devices you own or control, for your own non-commercial reading. This licence lasts only as long as you comply with these Terms.
The app, its design, its written editorial content, its illustrations and its catalogue remain ours or our licensors'. Nothing here transfers ownership of any of it to you.
5. Books you import
They stay yours
Files you import stay your property. We claim no ownership over them. We store them on your device and, if you subscribe to Premium, in a private cloud library tied to your account so your shelf survives a change of phone. We do not read, publish or share their contents.
You are responsible for what you import
By importing a file you confirm you have the right to hold and read that copy. Do not use Literary Atlas to store or distribute material you have no right to, and do not use it to strip or circumvent digital rights management (DRM). We do not supply the books you import, and we cannot verify their provenance.
Keep your own backups
Cloud storage for Premium subscribers is a convenience, not an archival service. Keep your own copies of any file that matters to you.
6. Acceptable use
Please do not:
- copy, resell, sublicense or redistribute the app or its catalogue content;
- reverse engineer or decompile the app, except where the law expressly allows it;
- probe, overload or interfere with our servers, or try to reach accounts or data that are not yours;
- use automated tools to scrape or bulk-download the catalogue;
- use the app to store or share unlawful material, or to break the law in any other way.
7. Literary Atlas Premium
What Premium covers
Premium unlocks read-aloud narration, instant translation, cloud sync for your imported library, reading goals and other features we mark as Premium. The set of features may change as the app grows. If we remove something significant from Premium, we will say so in the release notes.
Price, billing and renewal
Premium is an auto-renewing subscription sold through the App Store on iOS and Google Play on Android. The price and any free trial are shown on the purchase screen in your local currency before you confirm. Payment is charged to your Apple or Google account at confirmation.
The subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours of the end of the current period. Where a free trial applies, any unused part of it is forfeited when you buy a subscription.
Managing and cancelling
You manage and cancel your subscription in your store account, not in Literary Atlas: on iOS in Settings → Apple Account → Subscriptions, on Android in Google Play → Payments and subscriptions. Cancelling stops the next renewal; Premium stays active until the end of the period you already paid for. Deleting your Literary Atlas account does not cancel your subscription.
Refunds
Purchases are handled by Apple and Google, so refunds are governed by their policies and must be requested from them. We cannot issue refunds for store purchases. Where consumer law in your country gives you a right of withdrawal or a statutory refund right, that right applies and nothing here limits it.
Price changes
We may change the subscription price. Changes take effect at your next renewal, and you will be told in advance through the store in the manner Apple or Google requires. If you do not accept a new price, cancel before it takes effect.
8. Beta releases and complimentary Premium
Literary Atlas is currently distributed as a beta through TestFlight and Google Play testing. Beta software is unfinished by nature: it may contain defects, lose data, change without notice, or be withdrawn. It is provided for testing rather than as a finished product.
9. Amazon links and other third parties
Some books link out to Amazon so you can buy or read them in the Kindle app. Those links carry an affiliate tag. Anything you do on Amazon is between you and Amazon, under their terms and their privacy policy, and we are not a party to that purchase.
The app also relies on services we do not control, including Apple, Google, Supabase and the speech voices installed on your device. We are not responsible for their availability or their conduct.
10. Catalogue content
The Atlas catalogue mixes public-domain texts, factual records about works, authors and events, and editorial summaries. We check what we publish, but we cannot promise every date, attribution or summary is free of error. Treat it as a reading companion rather than a scholarly source, and please tell us when you find a mistake.
11. Availability and changes to the app
We aim to keep Literary Atlas running, but we do not promise uninterrupted service. We may change, suspend or discontinue features, and we may stop supporting older app or operating system versions. Where a change materially reduces what a paid subscription provides, you may cancel through your store as described above.
12. Disclaimers
To the fullest extent the law allows, Literary Atlas is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and your statutory consumer rights are unaffected.
13. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, nor for lost data or lost profits arising from your use of the app. Our total liability for any claim relating to Literary Atlas is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or ten Canadian dollars.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
14. Termination
You may stop using Literary Atlas at any time by deleting your account and uninstalling the app. We may suspend or end your access if you breach these Terms, if we are required to by law, or if we discontinue the app. On termination your licence ends; sections that by their nature should survive, such as those on intellectual property, disclaimers and liability, do survive.
15. Apple and Google
These Terms are between you and us, not with Apple or Google. Apple and Google are not responsible for the app or its support, and have no obligation to furnish maintenance or support for it. If the app fails to conform to any applicable warranty on iOS, you may notify Apple and Apple will refund the purchase price of the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms. Material changes will be noted on this page or in the app's release notes, and the effective date above will always show the latest revision. Continuing to use the app after a change means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts of the Province of Quebec have jurisdiction, except that if you are a consumer resident elsewhere you keep the benefit of any mandatory protections and any right to bring proceedings in the courts of your own country of residence.
18. General
If any provision of these Terms is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between us about Literary Atlas.
